Possession Order Requirements

Once a court ordered Possession Order is granted by the courts you will want to appoint a recovery agency to execute as soon as possible.

Permission to repossess the property is granted by your County Court and this is then progressed by the High Court. Your collection agency will then complete the required applications for a High Court Writ. Once this is all approved possession is typically gained within 7 days.

A ‘Suspended Possession Order’ may be granted if the Master (High Court Judge) deems that the tenant is able to settle any outstanding debts within a reasonable time.

The debt collection agency you work with will aim to protect your commercial and personal interests during this process. This process is an uncommon one for landlords looking to recover debts but your enforcement agency will be very experienced in this process.
